By engaging with eightlegink through any of our contact channels—including Messenger, WhatsApp, X, Telegram, Email, Call, or Text—you acknowledge that you have read, understood, and agree to be bound by these Terms and comply with all applicable laws and regulations of Canada and the Province of British Columbia. If you do not agree to these Terms, please refrain from using our Services.
2. Eligibility
You must be at least the age of majority in your province or territory of residence and capable of entering into a legally binding contract to use our Services. By using our Services, you represent and warrant that you meet this eligibility requirement.
3. Services Overview
eightlegink specializes in providing high-quality ink and toner products equivalent to OEM standards at competitive prices. We operate through a private sales model, conducting all transactions directly with our customers. Our products are shipped within Canada and the USA from Canadian warehouses operated by our supplier, ShopperPlus Inc.
4. Account Responsibility
While we do not require account creation for purchasing, you are responsible for providing accurate and complete information when engaging in transactions. You agree to update us promptly if any of your information changes. We are not liable for any loss or damage arising from your failure to provide accurate information.
5. Use of Services
You agree to use our Services for lawful purposes only and in compliance with these Terms. You shall not:
- Use the Services in any way that violates any applicable federal, provincial, local, or international law or regulation.
- Engage in any conduct that restricts or inhibits anyone's use or enjoyment of the Services.
- Impersonate or attempt to impersonate eightlegink, a BlurpleTech Inc. employee, another user, or any other person or entity.
- Use any robot, spider, or other automatic devices, processes, or means to access the Services for any purpose.
6. Ordering and Payment
a. Quotation and Invoicing
- Quotation: You may request a quote for our products through your preferred contact method.
- Invoicing: Upon agreement on products and pricing, we will send you an invoice detailing your order, including applicable taxes and shipping costs.
b. Payment Terms
- Payment Methods: We accept payment methods as specified in our Payment Policy, including but not limited to credit cards, e-transfers, and other agreed-upon methods.
- Payment Timing: Payment must be made in full before the order is processed and shipped.
- Currency: All prices are quoted and must be paid in Canadian Dollars (CAD) unless otherwise stated.
7. Shipping and Delivery
a. Shipping Locations
- We ship to addresses within Canada and the USA.
b. Processing and Delivery Time
- Processing Time: Orders are processed within 1-3 business days after payment confirmation.
- Delivery Time: Estimated delivery times are between 3-14 business days post-processing but may vary due to unforeseen factors.
c. Shipping Methods
- Drop-Shipping: Products are shipped directly from our supplier's Canadian warehouses operated by ShopperPlus Inc.
- Shipping Charges: Shipping and handling charges will be specified during the ordering process. Additional charges may apply for certain locations or expedited shipping options.
d. Customs and Duties
- For orders shipped to the USA, you are responsible for any customs duties, taxes, or fees imposed by the destination country.
e. Risk of Loss
- All items purchased are made pursuant to a shipment contract. Risk of loss and title for such items pass to you upon our delivery to the carrier.
8. Returns and Refunds
- Return Policy: Due to the nature of our products, all sales are final unless the product is defective or an incorrect item was sent.
- Defective or Incorrect Items: If you receive a defective or incorrect item, notify us within 5 days of receipt. We will provide instructions for return and either replace the item or issue a refund.
- Shipping Costs: We will cover return shipping costs for defective or incorrect items.

9. Privacy and Data Security
a. Data Collection and Use
- We collect only necessary information to process orders and communicate with you.
- Personal information is used solely for order ful-fillment and is not shared with third parties except as necessary to provide the Services.

- All customer data is stored on encrypted, offline hard drives to ensure maximum security.
- We employ reasonable security measures to protect your personal information but cannot guarantee absolute security.

10. Intellectual Property Rights
a. Ownership
- All content on our website and communications, including text, graphics, logos, images, and software, is the property of BlurpleTech Inc. or its content suppliers and is protected by Canadian and international copyright laws.

- You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material without our prior written consent.
11. Limitation of Liability
To the maximum extent permitted by law:
- Exclusion of Damages: BlurpleTech Inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill.
- Limitation of Liability: Our total liability to you for all claims arising out of or relating to these Terms or your use of the Services shall not exceed the amounts paid by you to us in the past six months.
12. Disclaimer of Warranties
- "As Is" Basis: The Services are provided on an "as is" and "as available" basis without warranties of any kind, either express or implied.
- No Warranty: We disclaim all warranties, express or implied, including but not limited to merchantability, fitness for a particular purpose, and non-infringement.
13. Governing Law
These Terms and any disputes arising out of or related to them or the Services will be governed by the laws of the Province of British Columbia and the federal laws of Canada applicable therein, without regard to its conflict of law principles.
14. Dispute Resolution
a. Negotiation
- Parties agree to attempt to resolve any dispute amicably through good faith negotiations.
b. Arbitration
- If a dispute cannot be resolved through negotiation, it shall be settled by binding arbitration in Abbotsford, British Columbia, in accordance with the Arbitration Act of British Columbia.
c. Exceptions
- Either party may seek injunctive relief for intellectual property infringement or other equitable remedies in a court of competent jurisdiction.
15. Changes to Terms
We reserve the right to modify these Terms at any time in our sole discretion. Changes will be effective immediately upon posting the updated Terms on our website. Your continued use of the Services after any such changes constitutes your acceptance of the new Terms.
16. Severability
If any provision of these Terms is held to be invalid or unenforceable, such provision shall be struck, and the remaining provisions shall be enforced.

These Terms, along with any policies or agreements expressly incorporated by reference, constitute the entire agreement between you and BlurpleTech Inc. regarding the Services.
